JOINT MOTION TO TERMINATE INVESTIGATION AS TO RESPONDENT
WHALEN FURNITURE MANUFACTURING, INC. BASED ON SETTLEMENT
AGREEMENT, CONSENT ORDER STIPULATION AND PROPOSED CONSENT
ORDER AND TO STAY OF THE PROCEDURAL SCHEDULE AS IT RELATES TO
WHALEN FURNITURE MANUFACTURING, INC.
Complainants Twin-Star International, Inc. and TS Investment Holding Corporation
(collectively, “Twin-Star" or “Complainants”) and Respondent Whalen Furniture Manufacturing,
Inc. (“Whalen”) hereby jointly move for termination of this investigation as to Whalen pursuant
to § 210.21 and for a stay of the procedural schedule as it relates to Whalen. Entry of the
Consent Order will resolve this investigation with respect to Whalen rendering termination with
respect to Whalen appropriate.‘ Additionally, in view of the upcoming Procedural Schedule
deadlines, a stay is appropriate so that the private parties, Commission Investigative Staff
(“Staff”) and Commission do not have to expend time, effort and resources that are unnecessary
in view of the relief sought in this motion.
Staff has indicated that it will file a response.
' As indicated below, Complainants are withdrawing certain allegations in the 826 Complaint,
and Complainants and \7Vhalenhave entered into a settlement agreement.

I.
TERMINATION OF THIS INVESTIGATION AS T0 WHALEN IS
APPROPRIATE BASED ON THE SETTLEMENT AGREEMENT AND
PROPOSED CONSENT ORDER
A Consent Order Stipulation executed by Whalen is attached as Exhibit l. A proposed
Consent Order is attached as Exhibit 2. A copy of the Parties’ Settlement Agreement is attached
as Exhibit 3. There are no agreements, written or oral, express or implied, between
Complainants and Whalen concerning the subject matter of this Investigation other than the
Confidential versions of those submitted herewith.
The United States International Trade Commission (“Commission”) instituted the above­
oaptioned investigation (the “Investigati0n”) under Section 337 of the Tariff Act of 1930 as
amended (19 U.S.C. § 1337), based upon the allegations in the Complaint filed by Twin-Star,
which alleged unfair acts in the importation into the United States, the sale for importation, and
the sale within the United States after importation, of certain electric fireplaces, components
thereof, manuals for same, certain processes for manufacturing or relating to same and certain
products containing same (“Subject Electric Fireplaces”) by, among others, Respondent Whalen
Furniture Manufacturing Inc. (“Whalen”).
Twin-Star and Whalen jointly request entry of the proposed Consent Order attached at
Exhibit 2, based on the stipulation attached at Exhibit 1 and the Settlement Agreement attached
at Exhibit 3 to this joint motion. Tennination of the investigation based on the terms of the
Settlement Agreement and entry of the proposed Consent Order will render moot the dispute
with respect to Twin-Star’s allegations of trade secret misappropriation and copyright
infringement against Whalen in the 826 Investigation. Twin-Star hereby withdraws its
allegations before the Commission of tortious interference with contract against Whalen.
PUBLIC VERSION
Accordingly, the Settlement Agreement and proposed Consent Order resolve all claims against
Whalen before the Commission.
Granting this motion for tennination of this investigation as to Whalen is in the public
interest, which favors the settlement of disputes to avoid needless litigation and to conserve
resources. See, e.g., Certain Compact Disc and DVD Holders, Inv. N0. 337-TA-482, Order No.
ll at 3 (March 7, 2003). Granting this motion for termination of this investigation as to Whalen
will streamline the case for hearing by removing one of the respondents and will result in savings
of Commission and party resources. Entry of the proposed Stipulation and Consent Order will
not impose an undue burden on the public health and welfare, competitive conditions in the
United States economy, production of like or directly competitive articles in the United States, or
United States consumers.
II.
A STAY OF THE PROCEDURAL SCHEDULE AS IT RELATES TO WHALEN
IS APPROPRIATE
A stay of the procedural schedule as it relates to Whalen is appropriate in view of the
relief being sought by this motion. There are several upcoming deadlines as set forth in the
Procedural Schedule. However, the requested entry of the Consent Order will resolve this
investigation as to Whalen. There is no need for the private parties, staff and the Commission to
expend additional time, effort and resources on the investigation as it relates only to Wha1en.2
III.
CONCLUSION
Accordingly, Twin-Star and Whalen respectively request that the Administrative Law
Judge issue an Initial Determination that the Investigation be terminated as to Whalen and that

WHEREAS, The United States international Trade Commission (“Commission”) has
instituted the above captioned investigation (the “investigation”) under Section 337 of the Tariff
Act of l 930 as amended (l 9 U.S.C. § 1337), based upon the allegations in the Complaint filed by
Twin-Star International inc. and TS investment Holding Corp. (“Complainants”), which alleged
unfair acts in the importation into the United States, the sale for importation, and the sale within
the United States after importation, of certain electric fireplaces, components thereof, manuals
for same, certain processes for manufacturing or relating to same and certain products containing
same (“Subject Electric Fireplaces”) by, among others, Respondent Whalen Furniture
Manufacturing lnc. (“Whalen”).
Whalen hereby stipulates and agrees as follows:
A.
Respondent Wlialen is a company organized and existing under the laws ofthe
state ofCalifornia, with its principal place of business at 1578 Air Wing Road,
San Diego, California 92154.

The Commission has in remjurisdiction over the Subject Electric Fireplaces
which are the subject of this investigation and the Commission has in persona/11
jurisdiction over Whalen for the purposes of this Stipulation and Consent Order.
Whalen stipulates that it shall not sell for importation, import into the United
States, or sell in the United States after importation, or knowingly aid, abet,
encourage, participate in, or induce the sale for importation, importation into the
United States, or sale in the United States, alone or incorporated with furniture
items or other products, (i) any electric fireplace inserts as shown in
Attachment A, or manufactured, either directly or indirectly, by Respondent
Reliap Industrial Co. (“Reliap”) and/or Jason Yue or any entity directly or
indirectly associated with Reliap and/or Jason Yue, or that infringe U.S.
Copyright Registration No. VA000l772669 or U.S. Copyright Registration No.
VAOOOIT/266l, or are produced using or which contain misappropriated Twin
Star trade secrets; and (ii) any manuals which infringe upon U.S. Copyright
Registration No. TXOO7350474or U.S. Copyright Registration No.
TX0007350476, or any manuals as shown in Attachment B, except under consent
or license from the Complainants, their successors, or assigns for a period of time
ending five (5) years from the date of the Settlement Agreement attached as
Exhibit 3 to the .Ioint Motion For Termination. Whalen agrees that it cannot
promote, sell, market, use and import (or cause to be imported) electric fireplace
inserts, alone or incorporated with furniture items or other products, for a period
ofone (1) year from the date of the Settlement Agreement attached as Exhibit 3
to the Joint Motion to Terminate, except for the electric fireplace inserts
embodying at least all ofthe characteristics as shown in Attachment C, as well as
additional models that embody a curved glass front as part of the facade.
Whalen expressly waives all rights to seekjudicial review or otherwise challenge
or contest the validity of the Consent Order, Attachment D.
Whalen will cooperate with and will not seek to impede by litigation or other
means the Commission’s efforts to gather information under subpart I of the
Commission’s Rules of Practice and Procedure, 19 C.P.R. §210.
Enforcement, modification, or revocation of the Consent Order will be carried out
pursuant to subpart I ofthe Commission’s Rules of Practice and Procedure, 19
C.F.R. §2l0.
The Consent Order shall not apply with respect to any claim of any intellectual
property right that has expired or been found or adjudicated invalid or
unenforceable by the Commission or a court or agency ofcompetentjurisdiction,
provided that such finding orjudgment has become final and nonreviewable.
Whalen will not seek to challenge the validity or enforceability of the intellectual
property rights set forth in the Complaint for Inv. No 337-TA-826 -—i.e., U.S.
Copyright Registration Nos. VA00O177266l, VA000l7'/'2669, TXOQ7350474,
TX0007350476 and Complainants’ asserted trade secrets (the “Subject
intellectual Property”) —in any administrative orjudicial proceeding to enforce
the Consent Order.
Whalen understands and acknowledges that with regard to the information it has
provided in the course ofdiscovery in the Investigation, including but not limited
to documents, interrogatory responses, and transcripts of sworn deposition

testimony, Complainants may seek to introduce such information as evidence in
the Investigation after Whalen has been terminated as a respondent. Whalen
hereby waives its right to object to, to rebut, or to otherwise address the
introduction of such information into the record of the Investigation.

Whalen understands and acknowledges that if the Commission enters this Consent
Order, Whalen will have waived its right to introduce evidence, cross-examine
witnesses, and otherwise participate in the lnvestigation in any fashion.
K.
The signing of this Stipulation and Proposed Consent Order is for settlement
purposes only and does not constitute an admission by Whalen that an unfair act
has been committed.
L.
Other than the Settlement Agreement attached as Exhibit 3 to the Joint Motion to
Terminate, there are no agreements, written or oral, express or implied, between
Whalen and Complainants concerning the subject matter of the Investigation.

INSTRUCTION MANUAL
When using electrical appliances, basic precautions should always be followed to reduce the risk or fire,
electrical shock, and/or iniuny including the following:
Read all instructions before using this appliance.
This appliance is hot when in use. To avoid burns,
do not let bare skin touch hot surfaces. if provided,
use handles when moving this appliance.

generated under certain abnormal conditions. Do
not partially or fully cover or obstruct the front of
the heater.
In order to avoid overheating, do
not cover the heater. It cannot be used in a closet.
The appliance should not be used
by children or persons with reduced physical,
sensory or mental capabilities.
Children should be advised not to play with the
appliance.
Always unplug this appliance when not in use.
Do not operate any heater with a damaged cord
or plug or after the appliance malfunctions, or if it
has been dropped or damaged iii any niaririer

This heater is not intended for use in bathrooms,

cord away from traffic areas and where itwill not
be tripped over
To disconnect this appliance, turn controls to the
off position, then remove plug from outlet.
Connect to properly grounded outlets only.
This appliance, when installed, must be
electrically grounded in accordance with local
codesor, in the absence of local codes, with the
current CSA C22.i Canadian Electrical Code or
for U.S A. Installations, follow local codes and the
National Electrical Code, ANSI/NFPA NO 70.
There is a protective thermostat limiter inside
the heater. When the inner temperature over
heats, the thermostat limiter willshut off the
power supply to avoid the risk of fire damage
to the appliance.
The heaters must not be located immediately
below a socket-outlet
Do not insert or allow foreign objects to enter any
ventilation or exhaust opening as this may cause
an electric shock or fire, or damage the appliance.
To prevent a possible fire, do not block air intakes
or exhaust in any manner. Do not use on soft
surfaces, like a bed, where opening may become
blocked

This heater is for use on 120 volts. The cord has
a plug as shown in figure i.See Figure 1 for
grounding instruction. An adapter as shown at C
is available for connecting three-blade grounding
type plugs to two-slot receptacles The green
grounding plug extending from the adapter must
be connected to a permanent ground such as a
properly grounded outlet box. The adapter
should not be used if a three-slot grounded
receptacle is available.

The motors used on the fan and the flame generator assembly are pre-lubricated for extended bearing lite and
require no further lubrication. However, periodic cleaning/vacuuming of the fenlheater unit is recommended. Make
eure the unit is turn OFF and unplugged whenever you are cleaning the heter orfireplace
Make sure the power is tumed off before proceeding‘ Any electrical repairs or rewiring
of this unit should be carried out by a licensed electrician in accordance with national and local codes.
If repairing or replacing any electrical component or wiring, the original wire routing. color coding
and securing locations muet be followed.
Electric outlet wiring must comply with local building codes and other
applicable regulations to reduce the risk of fire, electrical shock and injuryto persons.

POWER
The POWER button turns the appliance on or off. It has a memory function; the button turns offall functions
at once but retains the settings in the memory. By pressing the button again, the unit willturn on at the same
settings. Ifthe TIMER has been set 8. time has expired all functions willstop. Press the POWER button start
the appliance.
FLAME
The FLAMEcontrol switch manages the flame brightness. There are 4 brightness levels and an off position.
Each time the FLAMEbutton is pressed, the intensity of the flame decreases. When adjusting the FLAME
button, a number indicating the brightness of flame will be visible on the digital display. Alter turning on digital
display, if nothing happens within 10 seconds, digital display willturn off. There is a down light overthe
ember bed. When the FLAME button is in the ON position, down light willtum on, it will turn off in OFF
position.
The FLAME button has locking function. Press the FLAME button for 5 seconds. The down light willturn off.
When the ember bed light flashes 6 times, it is confirming the flame function is locked. To remove locking
function press FLAME button for 5 seconds, the ember bed light willflash 6 times, both the flame light and
ember bed willbe on.
HEATER
The HEATER button turns the heater on and off. When in ON position, press the HEATER button 5 seconds
and entertemperature adjustment mode. In the adjustment mode, the digital indicator willflash at .05 second

5 times and willexit from setting status. After turning on the digital temperature display, if nothing happens
within 10 seconds, digital display will expire.
Temperature Switch Function: Withthe HEATER in the ON position, press the POWER button for 5 seconds,
current temperature indicator willflash 3 limes; after that it willswitch to another temperature.
This button has a locking function. Press the HEATER button for 10 seconds, the ember bed light willflash 6
times, indicating that the HEATER function is locked. To remove locking the function press the HEATER
button 10 seconds the ember bed lightwillflash 6 times, indicating the locking function has been removed.
Press HEATER button again, and the heating function will resume.
TIMER
The TIMER has adjustable settings at 30 minute intervals. After turning on the digital display if nothing
happens for 10 seconds the display willshut off. After the desired (set) time has expired the TIMER
indicator light willflash 6 times and all functions will stop. All appliance settings EXCEPT the TIMER willbe
retained in the memory.
After entering the time setting press the power button to remove the setting function and retain in the
memory.

grounding instruction. An adapter as shown at C
is available for connecting three-blade grounding
type plugs to two-slot receptacles. The green
grounding plug extending from the adapter must
be connected to a permanent ground such as a
properly grounded outlet box. The adapter
should not be used ifa three-slot grounded
receptacle is available.

Wire cord, exiting from the rear of the fireplace. Plan
the installation to avoid the use of an extension cord.
If an extension cord must be used‘ it must be a
minimum ‘I6 AWG. thiee wires with grounding type
plug connection and rated not less than 1875 Watts
The cord shall not be more than 20 feet (Gm) in
length.
Clean the metal trim using a soft cloth, slightly
dampened with citrus oil based product and buff

or household cleaners as these products willdamage

obtained at supermarkets or hardware stores

The motors used on the fan and the flame generator assembly are pre-lubricated for extended bearing life and
require no further lubrication. However, periodic cleaning/vacuuming of the fan/heater unit is recommended. Make
sure the unit is turn OFF and unplugged whenever you are cleaning the heater or fireplace,

ofthis unit should be carried out bv a licensed electrician in accordance with national and local codes
if repairing or replacing any electrical component or wiring, the original wire routing, color coding
and eecurin locations must be followed.

applicable regulations to reduce the risk of fire, electrical shock and injuryto persons,
not use this fireplace if any part of it has been under water. immediately
call a qualified service technician to inspect the fireplace and replace any pert of the

POWER
The POWER button turns the appliance on or off it has a memory function; the button turns off all functions
at once but retains the settings in the memory. By pressing the button again, the unit willturn on at the same
settings‘. lfthe TIMER has been set B.time has expired all functions willstop. Press the POWER button start
the appliance.
FLAME
The FLAMEcontrol switch manages the flame brightness. There are 4 brightness levels and an off position.
Each time the FLAMEbutton is pressed, the intensity ofthe flame decreases. When adjusting the FLAME
button, a number indicating the brightness offlame will be visible on the digital display. Alter turning on digital
display, if nothing happens_within 10 seconds, digital display willturn off. There is a down light overthe
ember bed. When the FLAME button is in the ON position, down light willturn on, it willturn off in OFF
position..

The FLAME button has locking function. Press the FLAME button for 5 seconds. The down light willturn off.
When the ember bed light flashes 6 times, it is confirming the flame function is locked. To remove locking
function press FLAME button for 5 seconds, the ember bed light willflash 6 times, both the flame light and
ember bed willbe on.
HEATER
The HEATER button turns the heater on and off. When in ON position, press the HEATER button 5 seconds
and entertemperature adjustment mode. Inthe adjustment mode, the digitalindicator willflash at .05 second
intervals. There are 23 temperature

indicator willflash 5 times and will exit from setting status. After turning on the digital temperature display. if
nothing happens within 10 seconds, digital display will expire.
Temperature Switch Function: Vtflththe HEATER in the ON position, press the POWER button for 5 seconds,
current temperature indicator willflash 3 times; afterthat it willswitch to another temperature.
This button has a locking function. Press the HEATER button for 10 seconds, the ember bed lightwillflash 6
times, indicating that the HEATERfunction is locked. To remove locking the function press the HEATER
button 10 seconds the ember bed light willflash 6 times, indicating the locking function has been removed.
Press HEATER button again, and the heating function will resume.
TIMER
The TIMER has adjustable settings at 30 minute intervals. Alterturning on the digital display if nothing
happens for 10 seconds the display willshut off. After the desired (set) time has expired the TIMER
indicator light willflash 6 times and all functions will stop. All appliance settings EXCEPT the TIMER willbe
retained in the memory.
After entering the time setting press the power button to remove the setting function and retain in the
memory.
OPERATION INSTRUCTIONS WITH REMOTE
POWER

FLAME
The FLAMEbutton manages the flame brightness. Each time the FLAMEbutton is pressed the intensity of

replacement of part(s) found to be defective
in material or workmanship, provided that
such part(s) have been subjected to normal

discharge all obligations with respect to this
warranty by refunding the wholesale price of

PROPOSED CONSENT ORDER
The United States International Trade Commission (“Commission”) has instituted the
above captioned investigation (the “Investigation”) under Section 337 of the Tarifi‘Act of 1930
as amended (19 U.S.C. § 1337), based upon the allegations in the Complaint filed by Twin-Star
International Inc. and TS Investment Holding Corp. (“Complainants”), which alleged unfair acts
in the importation into the United States, the sale for importation, and the sale within the United
States afier importation, of certain electric fireplaces, components thereof, manuals for same,
certain processes for manufacturing or relating to same and certain products containing same
(“Subject Electric Fireplaces”) by, among others, Respondent Whalen Fumiture Manufacturing
Inc. (“Whalen”).
Whalen has executed a Consent Order Stipulation in which it agrees to the entry of this
Consent Order and to all waivers and other provisions as required by the Commission’s Rules of
Practice and Procedure, and has filed a Motion for Tennination of the Investigation with respect
to Whalen based on the Consent Order Stipulation. In particular, Whalen has stipulated as
fol lows:
Respondent Whalen is a company organized and existing under the laws of the
state of Califomia, with its principal place of business at 1578 Air Wing Road,
San Diego, California 92154.
The Commission has in rem jurisdiction over the Subject Electric Fireplaces
which are the subject of this Investigation and the Commission has in pcrsonam
jurisdiction over Whalen for the purposes of this Stipulation and Consent Order.
Whalen stipulates that it shall not sell for importation, import into the United
States, or sell in the United States after importation, or knowingly aid, abet,
encourage, participate in, or induce the sale for importation, importation into the
United States, or sale in the United States, alone or incorporated with fiumiture
items or other products, (i) any electric fireplace inserts as shown in
Attachment A, or manufactured, either directly or indirectly, by Respondent
Reliap industrial Co. (“Reliap”) and/or Jason Yue or any entity directly or
indirectly associated with Reliap and/or Jason Yue, or that infringe U.S.
Copyright Registration No. VA000l772669 or U.S. Copyright Registration No.
VAO00l 772661, or are produced using or which contain misappropriated Twin
Star trade secrets; and (ii) any manuals which infringe upon U.S. Copyright
Registration No. TX007350474 or U.S. Copyright Registration No.
TX0007350476, or any manuals as shown in Attachment B, except under consent
or license from the Complainants, their successors, or assigns for a period of time
ending five (5) years from the date of the Settlement Agreement attached as
Exhibit 3 to the Joint Motion For Termination. Whalen agrees that it cannot
promote, sell, market, use and import (or cause to be imported) electric fireplace
inserts, alone or incorporated with fiirniture items or other products, for a period
of one (1) year from the date of the Settlement Agreement attached as Exhibit 3
to the Joint Motion to Terminate, except for the electric fireplace inserts
embodying at least all of the characteristics as shown in Attachment C, as well as
additional models that embody a curved glass front as part of the facade.
Whalen expressly waives all rights to seek judicial review or otherwise challenge
or contest the validity of the Consent Order.
Whalen will cooperate with and will not seek to impede by litigation or other
means the Commission’s efforts to gather information under subpart 1 of the
Commission’s Rules of Practice and Procedure, 19 C.F.R. §2l0.
Enforcement, modification, or revocation of the Consent Order will be carried out

introduction of such information into the record of the Investigation.
Whalen understands and acknowledges that if the Commission enters this Consent
Order, Whalen will have waived its right to introduce evidence, cross-examine ‘
witnesses, and otherwise participate in the Investigation in any fashion.
The signing of this Stipulation and Proposed Consent Order is for settlement
purposes only and does not constitute an admission by Whalen that an unfair act
has been committed.
Other than the Settlement Agreement attached as Exhibit 3 to the Joint Motion to
Terminate, there are no agreements, written or oral, express or implied, between
Whalen and Complainants concerning the subject matter of the Investigation.

indirectly associated with Reliap and/or Jason Yue, or that infringe U.S.
Copyright Registration No. VA000l772669 or U.S. Copyright Registration N0.
VA0001772661, or are produced using or which contain misappropriated Twin
Star trade secrets; and (ii) any manuals which infringe upon U.S. Copyright
Registration No. TX007350474 or U.S. Copyright Registration No.
TX0007350476, or any manuals as shown in Attachment B, except under consent
or license from the Complainants, their successors, or assigns for a period of time
ending five (5) years from the date of the Settlement Agreement attached as
Exhibit 3 to the Joint Motion. Further, Whalen cannot promote, sell, market, use
and import (or cause to be imported) electric fireplace inserts, alone or
incorporated with furniture items or other products, for a period of one (1) year
from the date of the Settlement Agreement attached as Exhibit 3 to the Joint
Motion, except for the electric fireplace inserts embodying at least all of the
characteristics as shown in Attachment C, as well as additional models that
embody a curved glass front as part of the facade.
Whalen shall be precluded from seekingjudicial review or otherwise challenging
or contesting the validity ofthis Consent Order.
Whalen shall cooperate with and shall not seek to impede by litigation or other
means the Commission’s efforts to gather information under subpart I ofthe

PROPOSED CONSENT ORDER
The United States Intemational Trade Commission (“Commission”) has instituted the
above captioned investigation (the “Investigation”) under Section 337 of the Tariff Act of 1930
as amended (l 9 U.S.C. § i337), based upon the allegations in the Complaint filed by Twin-Star
International lnc. and TS Investment Holding Corp. (“Complainants”), which alleged unfair acts
in the importation into the United States, the sale for importation, and the sale within the United
States after importation, of certain electric fireplaces, components thereof, manuals for same,
certain processes for manufacturing or relating to same and certain products containing same
(“Subject Electric Fireplaces”) by, among others, Respondent Whalen Fumiture Manufacturing
lnc. (“Whalen”).
Whalen has executed a Consent Order Stipulation in which it agrees to the entry of this
Consent Order and to all waivers and other provisions as required by the Commission’s Rules of
Practice and Procedure, and has filed a Motion for Termination of the Investigation with respect
to Whalen based on the Consent Order Stipulation. In particular, Whalen has stipulated as
follows:
Respondent Whalen is a company organized and existing under the laws of the
state ofCalit'ornia, with its principal place of business at 1578 Air Wing Road,
San Diego, Califomia 92154.
The Commission has in rem jurisdiction over the Subject Electric Fireplaces
which are the subject of this Investigation and the Commission has in personam
jurisdiction over Whalen for the purposes of this Stipulation and Consent Order.
Whalen stipulates that it shall not sell for importation, import into the United
States, or sell in the United States afier importation, or knowingly aid, abet,
encourage, participate in, or induce the sale for importation, importation into the
United States, or sale in the United States, alone or incorporated with fumiture
items or other products, (i) any electric fireplace inserts as shown in
Attachment A, or manufactured, either directly or indirectly, by Respondent
Reliap Industrial Co. (“Reliap”) and/or Jason Yue or any entity directly or
indirectly associated with Reliap and/or Jason Yue, or that infringe U.S.
Copyright Registration No. VA000l772669 or U.S. Copyright Registration No.
VA000l77266l, or are produced using or which contain misappropriated Twin
Star trade secrets; and (ii) any manuals which infringe upon U.S. Copyright

There ls a protective thermostat limiter inside
the heater. When the inner temperature over
heats, the thermostat limiterwill shut off the
power supply to avoid the risk of fire damage

The POWER button turns the appliance on or off. it has a memory function; the button turns off all functions

FLAME
The FLAMEcontrol switch manages the flame brightness. There are 4 brightness levels and an off position.
Each time the FLAMEbutton is pressed, the intensity of the flame decreases. When adjusting the FLAME
button, a number indicating the brightness of flame willbe visible on the digital display. Afler turning on digital
display, if nothing happens within 10 seconds, digital display willturn off. There is a down light overthe
ember bed. When the FLAME button is in the ON position, down light will turn on, it willturn off in OFF
position.
The FLAME button has locking function. Press the FLAME button for 5 seconds. The down light willturn off.
When the ember bed light flashes 6 times, it is confirming the flame function is locked. To remove locking
function press FLAME button for 5 seconds, the ember bed light willflash 6 times, both the flame light and
ember bed willbe on.
HEATER
The HEATER button turns the heater on and off. When in ON position, press the HEATER button 5 seconds
and entertemperature adjustment mode. Inthe adjustment mode, the digital indicator willflash at .05 second

This button has a locking function. Press the HEATER button for 10 seconds, the ember bed light willflash 6
times, indicating that the HEATER function is locked. To remove locking the function press the HEATER
button 10 seconds the ember bed light willflash 6 times, indicating the locking function has been removed.
Press HEATER button again, and the heating function willresume.
TIMER
The TIMER has adjustable settings at 30 minute intervals. Afterturning on the digital display if nothing
happens for 10 seconds the display willshut off. After the desired (set) time has expired the TIMER
indicator light willflash 6 times and all functions will stop. All appliance settings EXCEPT the TIMER willbe
retained in the memory.
Afler entering the time setting press the power button to remove the setting function and retain in the
memory.

a plug as shown in figure l.See Figure 1 for
grounding instruction. An adapter as shown at C
is available for connecting three-blade grounding
type plugs to two-slot receptacles. The green
grounding plug extending from the adapter must
be connected to a permanent ground such as a
properly grounded outlet box. The adapter
should not be used if a three-slot grounded
receptacle is available.

POWER
The POWER button turns the appliance on or off. it has a memory function; the button turns off all functions
at once but retains the settings in the memory. By pressing the button again, the unit willturn on at the same
settings. lfthe TIMER has been set& time has expired all functions willstop. Press the POWER button start
the appliance.
FLAME
The FLAMEcontrol switch manages the flame brightness. There are 4 brightness levels and an off position.
Each time the FLAMEbutton is pressed, the intensity ofthe flame decreases. When adjusting the FLAME
button, a number indicating the brightness of flame will be visible on the digital display. After turning on digital
display, if nothing happens within 10 seconds, digital display willtum off. There is a down light over the
ember bed. When the FLAME button is in the ON position, down light will turn on, it willturn off in OFF
position..
The FLAME button has locking function. Press the FLAME button for 5 seconds. The down light willturn off.
When the ember bed light flashes 6 times, it is confirming the flame function is locked. To remove locking
function press FLAME button for 5 seconds, the ember bed light willflash 6 times, both the flame light and
ember bed will be on.
HEATER
The HEATER button tums the heater on and off. When in ON position, press the HEATERbutton 5 seconds
and entertemperature adjustment mode. in the adjustment mode, the digitalindicator willflash at .05 second
intervals. There are 23 temperature settings: 72“l~‘—73"F —74"l-‘---82"F*ON~0FF—62"l~‘—63“F —64“l~‘---71
“F( 22"C ~23"C —24"C---27°C-ON—0FF—17'C —18‘C---21°C). After the temperature is selected the digital
indicator will flash 5 times and will exit from setting status. After turning on the digital temperature display, if
nothing happens within 10 seconds, digital display willexpire.
Temperature Switch Function: With the HEATER in the ON position, press the POWER button for 5 seconds,
current temperature indicator willflash 3 times; after that it willswitch to another temperature.
This button has a locking function. Press the HEATERbutton for 10 seconds, the ember bed light willflash 6
times, indicating that the HEATER function is locked. To remove locking the function press the HEATER
button 10 seconds the ember bed light willflash 6 times, indicating the locking function has been removed.
Press HEATERbutton again, and the heating function will resume.
TIMER
The TIMER has adjustable settings at 30 minute intervals. After turning on the digital display if nothing
happens for 10 seconds the display willshut off. Afterthe desired (set) time has expired the TIMER
indicator light will flash 6 times and all functions will stop. All appliance settings EXCEPT the TIMER will be
retained in the memory.
Alter entering the time setting press the power button to remove the setting function and retain in the
memory.

El tiutén de ENERGIAenclende y apaga al aparato. El equipo tiene una lunclén de memoria; el boton apaga

se encendera nuevamente can los mismos ajustes. Si se ha ajustado ei TEMPORIZADORy el tiempo se ha

El lnlerruplor de control de la LLAMAconlrola la brlllantez de la llama.Hay4 niveles de brillantez y una
pasicibn de apagado. Cacla vez que se preslona el bulén LLAMA,la intensidad de la llama disminuye. Al
ajus-tar el botan LLAMA.aparecera en la pantalla digital un mimero indicando el grade de brillantez de la
llama.Despué$ de encerider la pantalla digitalsi no sucede nada en 10 segundos, se apagaré la pantalla
digital. Hay una Iuz hacia abalo que llumina el lecho de brasas.Cuando el botén LLAMAse coloca en la

El botén del CALENTADORenciende y apaga el calentador. Cuando esta en la posicién ENCENDIDO,
presione el botén del CALENTADOR5 segundos y seleccione la modalidad de ajuste de temperatura. En la
modalidad de ajuste,el indicador digitaldestellaré a intervalos de 0.05 segundos.Hay 23 ajustes temperatura

TIMER
IEITEMPORIZADORtiene ajustes que se pueden regular a intervalos de 30 mlnutos Después tie encencier
la pantalla digital, si no sucede nada en10 segundos, se apagara la pantalla digital. Despuas que haya
terminado el tiempo deseado (ajustado), la Iuz indicadora del TEMPORIZADORdestellara 6 vases y ledas

allegations against 21subset of the Respondents (consolidated as the "826/791 Investigation“).
WHEREAS, Whalen has imported. sold and had mimufaegturedelectric fireplace
furniture incorporating electric fireplace inserts manufacturecl by rind purchased from Twin­
Star's former employee and allegedly currcnl shareholder Respondent Jason Yue and Yue’s
company Relinp, (the “Whalen-Rt-:liztpProducts");
WHEREAS, the Parties agree to resolve certain disputes. including settlement of the
826/791 Investigation, in accordance with the terms of this Agreemenl; and
WHEREAS, in consideration of the mutual promises, mulhal covenants. and mutual
agrcernents liereinafter sot fortli, and for other good and valuable Cionsiderutlon,the receipt and
sufficiency of which are hereby acknowledged, Twin-Star and Whlalonagree to the Specific
