This Schedule provides the details for Direct Order/Direct Supply Contract Number 115.
A revised ‘Issue’ number is allocated to the Schedule each time supplier or pricing information is updated.
Each new issue provides at the foot of the page, a description of the revisions concerned and a date on which
they become effective.
Contract scope
Products included are playground equipment, safety surfacing, multi-use games areas, skate parks, line
marking and other related equipment. Associated services include installation, inspection and maintenance,
bespoke design and ‘stakeholder engagement’ services. The Framework will provide the opportunity for
further competition and some call off solutions.
This Framework Agreement has been established through a collaborative procurement exercise undertaken by
the public sector buying consortia comprising the ‘Pro5 Group’.

Pricing, where provided, excludes VAT but includes delivery charges (assuming minimum order quantities

1. Introduction
Eastern Shires Purchasing Organisation (ESPO) is a local authority purchasing and distribution consortium,
jointly operated by the county councils of Cambridgeshire, Leicestershire, Lincolnshire, Norfolk and
Warwickshire and the unitary authorities of Leicester and Peterborough City Councils.
On behalf of the Pro5 group of professional buying organisations (CBC, ESPO, NEPO, WMS and YPO),
ESPO has established a framework of suitably experienced, qualified and resourced suppliers to provide
Outdoor Playground related products and associated services in a number of areas, available for use by local
authorities (and other bodies where applicable) and other public sector bodies nationally.
An Open Tender1 process was conducted, inviting bids in relation to the provision of Outdoor Playground
related products and associated services. The tender process allowed bidders to indicate their particular areas
of specialism and the resultant framework is categorised to reflect these areas of specialism. The framework
will commence on 1 April 2009 and will be in place for a period of 3 years (with an option to extend the
arrangement by a further one year). Clients may select from 12 categories of product or service within the
framework which are as follows:
1. General Playground Equipment and Safety Surfacing, design, supply and installation of Metal and
Timber equipment from catalogue ranges and including companies capable of providing Landscaping
and Sun-Shades.
2. Other Areas – Allows for the provision of play areas that include the types of equipment listed below
that are not available from the companies in the General Playground category above:
i) Electronic Outdoor Play Equipment
ii) Musical / Sound Play Equipment
iii) Wooden Carvings, Artwork, Very Large Wooden Structures
iv) Outdoor Fitness Equipment (Gymnasium style)
3. Multi Use Games Area (MUGAs)
4. Skate / BMX Parks (Concrete and Non-Concrete)
5. Bespoke design, construction and installation of equipment
6. Stake holder engagement projects, offering a ‘turn–key’ project management service, consulting with
end users and the wider community.
7. Line Marking in isolation form playground installation
8. Wetpour rubber safety surface in isolation from other playground equipment installation
9. Rubber tiles in isolation from other playground equipment installation
10. Bark Chippings in isolation from other playground equipment installation
11. Supply Only (Product and Spare Parts)
12. Inspection and Maintenance

2. Establishing the Framework
2.1.
General
ESPO, as a Central Purchasing Body2 acting on behalf of the Pro5 group of Professional Buying
organisations has established the terms and conditions which will apply to any call-off arrangements by
customers during the period of the Framework3 (commencing 1st April 2009). ESPO reserves the right in
exceptional circumstances to vary the composition of the Framework. For example, if a supplier fails
significantly to perform as required they may be removed (see Section 4 Monitoring the Framework).
A detailed and thorough evaluation of the tenders was completed by officers of ESPO. The objective of
the framework was not to promote one single ‘preferred solution’, but instead to offer a range of
solutions aimed at meeting a wide range of playground requirements from a number of leading system
providers in the marketplace. The evaluation therefore resulted in twenty six companies being selected
over the twelve lots with the largest number of suppliers in a single lot being eleven in the general
playground equipment category.
It is anticipated that day to day transactions (including undertaking secondary further-competitions, the
appointment of suppliers to specific jobs, and delivery of and payment for services) will all be conducted
directly between the client and the supplier, unless otherwise instructed by the Pro5 member. A copy of
the quotation must be sent to the Pro5 member if requested.
In establishing this framework, a standard set of end user terms and conditions was included and these
terms and conditions will apply to any work undertaken under this framework. Successful suppliers have
been advised that these conditions will be the default conditions unless the client is advised otherwise at
point of placing an official order and accepts such amendments.
In the event that a client is unable to identify a suitable category of product/service supply within the
Framework, the client should in the first instance contact the relevant Pro5 member to seek further
advice.

2.2
Contractual Structure
The framework agreement between ESPO and the five suppliers is in place for an period of up to four
years, commencing 1 April 2008. Please note, however, that there is no limit (within reason) to the
duration of individual contracts awarded under cover of the framework.

2.3 Evaluation of Tender submissions
Evaluation was conducted in relation to each of the 12 specific categories, resulting in each category list
being made up of a number of suppliers. The highest scoring organisations were awarded a position on
the framework within the relevant category.
Tenders submitted in response to this market engagement were evaluated by officers of ESPO, against a
set of pre-determined evaluation criteria which are as follows:

AWARD CRITERIA
Tenderers were evaluated using the CIPFA price scoring method and the following non-price scoring
method to determine the most economically advantageous tender.
The weightings are as follows:Price = 40%
Non Price = 60%
The total price score added to the Non price score will give the Grand Total of points scored and the
contract will be awarded to the tenderer/s with the highest points.
The price score can be calculated as maximum points x (100% -% above lowest price) based on the
CIPFA methodology. See example below.

3. Using the Framework
3.1.
Benefits of using the Framework
Using the Outdoor Playground Equipment framework can bring a number of benefits to clients:
•
Clients can either call off from the framework, or re-open competition within it, removing the need
for clients to conduct full tender exercises or lengthy supplier evaluations each time they have a
Playground equipment/service requirement, saving both the time and cost associated with
procurement exercises.
•
The established Framework is fully compliant with the Public Contracts Regulations 2006.
•
Terms and conditions are established to underpin the framework
•
The Framework will be managed and monitored by the relevant Pro5 member. In managing this
contract on behalf of our clients, your views and requirements will be taken into account when
reviewing and developing the contract.
•
No need to go through a full EU tender process – ESPO has already carried out a tender process
which is fully compliant with UK and European procurement law, thereby saving you valuable
time and resources with greatly reduced procurement timescales. In particular, there is no need to
advertise the contract, and there are no minimum time periods within the process to which you
must adhere.
•
Suppliers listed in the framework have already been assessed for their financial stability, track
record, experience, technical and professional ability, giving client authorities confidence to
purchase with minimal further vetting.
•
Access to a choice of suppliers who between them offer a comprehensive, range of products and
services for outdoor playground provision.
•
Suggested, pre-agreed terms, conditions and safeguards to underpin all contracts placed under the
framework.
•
Professional procurement support always on hand from ESPO. Whilst the aim of the framework is
to simplify the process by covering all procedural compliance matters on your behalf, it is
recognised that sometimes specific guidance, advice or assistance may be required; this is always
freely available from ESPO.
•
And finally – there is no charge for using the ESPO framework. ESPO’s statutory obligation to
recover the costs of its operation are already separately covered, so you will not face any bills of
any kind for ESPO services or for accessing the framework agreement.
3.2.
•
Using the ESPO framework is simple
Please always quote ‘ESPO/Pro5 framework reference 115’ in all your communications with
suppliers.
•
Either … run a ‘secondary (mini) competition’ – i.e. seek quotations from the framework
suppliers to secure offers tailored to your exact requirements. (This is generally the
recommended way of engaging with the ESPO framework).
•
Or … identify your chosen solution and supplier, based on the information provided in
this User Guide, agree supply terms with the supplier and place an order. This method is
only suitable if a comparison is possible from the information available and so will have
limited use for this contract.

3.2.1.
Conducting Further-competition
Where the terms laid down in the framework are not precise or complete enough for the particular
call-off then the right is reserved for the client to re-open competition under this Framework4. This
does not mean that basic terms can be renegotiated, or that the specification used in setting up the
framework can be substantively changed. Substantive modifications to the terms set out in the
framework agreement itself are not permitted. It is more a matter of supplementing or refining the
basic terms to reflect particular circumstances for the individual call-off. Examples of such terms
are:
o
Particular delivery timescales;
o
Particular invoicing arrangements and payment profiles, for example, progress payments;
o
Additional security needs;
In order to adhere to The Public Contracts Regulations 2006 for re-opening competition5, clients
must follow the steps outlined below:
1. The client must invite all suppliers who are a party to the Framework and who are capable of
delivering the customer’s particular requirement except those (if any) who clearly cannot meet
your requirements. In commissioning work therefore from this Framework, clients must invite
all suppliers within the relevant category they wish to procure from, for example, if a client
wished to procure general playground equipment consisting of either metal, timber or a
combination of both from catalogue ranges, the client would need to invite all awarded suppliers
within the general playground equipment category of the Framework to participate. This
framework covers a number of different categories of supplies and services and the client only
need consult providers in the categories that cover the goods or services required. If the
requirement spans more that one of the categories then the suppliers in all relevant categories
should be invited to tender.
2. The customer shall formulate a project brief containing full details of the work required. This
should include as a minimum a set of outcomes the supplier is expected to deliver, and the
timescale within which they are required to deliver the products/services.
3. The customer shall send the brief to all suppliers within the category (either in writing or by
email) inviting them to submit a tender, setting a time limit for the submission of written
responses (which must be submitted in written format and not via email in order to adhere to
point 4 below).
4. The written responses should be kept confidential until the tender return deadline has passed.
5. Your tender document must tell bidders the basis on which you will evaluate their offers, this
will be the most economically advantageous tender on the basis of the award criteria set out in
the framework at 2.4 above. New award criteria may be added as long as they relate to the
award criteria set out in the framework and weighting may be varied to reflect the particular
requirement.
6. You must allow bidders sufficient time to prepare and submit their bids – the more complex the
requirement, the longer you should allow. You must tell suppliers the time and date by when
they must have submitted their bids.
7. Evaluate your tenders in accordance with the criteria previously established – you may meet
with bidders to explore their offers in more depth if this assists you in making your choice of
supplier
8. Advise all bidders of the outcome.

3.2.2
Place and order (without secondary competition)
•
If you know precisely what solution you require, and using the information provided in this
User Guide (perhaps supplemented using suppliers’ technical information) you have identified
that there is only one supplier who can meet your requirements, then you may simply contact
the appropriate supplier and agree the placing of an official order.
•
Using this approach, you are not reopening competition under the framework, and you
therefore should not engage in substantive negotiations with the supplier, on matters such as
specification or product functionality. To remain compliant with the relevant regulations, you
must
a)
be sure that none of the other suppliers listed in the relevant category of the
framework can meet your specific requirements; and
b)
agree a price with your chosen supplier.
These conditions may often be difficult to meet, however, and for this reason ESPO
recommends that Option 1 is normally followed, i.e. a secondary competition.
4. Monitoring the Framework
As this is a framework, from which customers can call off or conduct mini-competitions, ESPO will not
be involved in the day-to-day management of the suppliers and the products/services they provide. ESPO
will however be closely monitoring the progress and performance of the arrangements throughout the
entire duration of the framework to ensure that customer’s requirements are being adequately met.
In monitoring this contract, any feedback you wish to provide should be sent to David Johnston (as per
the contact details on page 2 of this document). The feedback may be in any format, but to give clients
some direction, an example feedback form is included within this guide, see Schedule D.
