APPLICATION FOR A TARIFF CONCESSION ORDER (TCO)
The form should be read carefully before being completed
(a) Before lodging an application for a TCO, the applicant should determine whether a suitable TOO already exists. Information
on existing TCOs is contained in the schedule of Concessional Instruments (SC/), a copy of which is available at each
Regional Office of Customs. A TOO can be used by any importer.
(b) An application will be date stamped on the day it is first received in Canberra by an officer of Customs. Receipt of an
application will be acknowledged. Any resultant TOO will operate from the date of receipt. Instructions on how to lodge this
form are provided at the end of this form.
(c) Where an application is accepted as being a valid application, the identity of the applicant and of the importer for whom
the applicant is acting will be published in the Gazette.
(d) Section 269F of the Customs Act 1901 requires that a TOO application to be in writing, be in an "approved form", contain
such information as the form requires, and be signed in the manner indicated in the form. This is the approved form for
the purposes of that section.
(e) Section 269FA of the Customs Act 1901 states "It is the responsibility of an applicant for a TOO to establish, to the
satisfaction of the Chief Executive Officer (CEO), that, on the basis of:
(i) all information that the applicant has, or can reasonably be expected to have; and
(ii) all inquiries that the applicant has made, or can reasonably be expected to make;
there are reasonable grounds for asserting that the application meets the core criteria". The application is taken to meet
the core criteria if, on the day of lodgement of the application, no substitutable goods were produced in Australia in the
ordinary course of business.
(f) Every question on the form must be answered. Failure to supply the information required by this form will result in
rejection of the application (and in the loss of operative date).
(g) Where the form provides insufficient space to answer a question, an answer may be provided in an attachment. The
attachment should clearly identify the question to which it relates.
(h) All information about inquiries into the production of substitutable goods must relate to the date the application is lodged
with Customs.
(i) Customs may require an applicant to substantiate, with documentary evidence, any information provided in the application form.
(j) Further information on the Tariff Concession System is available in Part XVA of the Customs Act 1901, in the foreword to
the SCI, in the administrative guidelines in Volume 13 of the Australian Customs Service (ACS) Manual, in Australian
Customs Notice No. 98/19, or by phoning (02) 6275 6666.

The description of the goods in the application will be used as the description of the goods in the TCO (if made).
The application should provide a full description of the goods, including the physical features of the goods or the various
components of the goods. It should not describe the goods in terms of what they do.
In accordance with section 269SJ of the Customs Act 1901, the CEO must not make a TCO in respect of goods:
described in terms other than in generic terms; or
(i)
described in terms of their intended end use; or
(ii)
declared by the regulations to be g'bods to which a TCO should not be extended.
(iii)
Goods will be taken to be described in terms other than in generic terms if, for example, their description, either directly or by
implication, indicates that they are goods of a particular brand or model, or that a particular part number applies to the goods.
Guidance on the drafting of the description of goods is contained in Volume 13 of the ACS Manual and in Australian Customs
Notice No. 98/19.

A local manufacturer's goods are substitutable when they are put, or are capable of being put, to a use that corresponds with
a use (including a design use) to which the goods the subject of the application can be put (subsection 269B(1) of the Customs
Act 1901). Even if not identical, locally made goods may be substitutable.
In do_lermining whether the uses of Australian produced goods correspond with the uses of the goods the subject of the
ap, )tion, the ability of the goods to compete with each other in any market is not relevant.
The applicant must provide written information as to the inquiries made to establish that there are reasonable grounds for believing
that there are no producers of substitutable goods in Australia. The application must incli.0 a copy of the research material sourced
and a copy of correspondence to, and replies from, potential local manufacturers or relevTnt industry associations. The application
will be rejected if it fails to provide all written information as to the inquiries made.
NOTE: The Australian Customs Service suggests that potential local manufacturers should be given at least 10 working days to respond to
inquiries concerning local manufacture.

Bird Control NetTM is a premium quality knitted drape-over barrier net designed to provide optimum crop
protection against bird attack year in, year out. Bird Control Net is widely proven in all weather
conditions and against bird attacks which range in scope from tiny silver eyes to larger more aggressive
species including king parrots and bowers. And because Bird Control Net is made from UV stabilised
High Density Polyethylene monofilament using a twin lock-stitch construction it resists tearing and
fraying during installation and removal.
Bird Control Net is manufactured with a fully reinforced selvedge (which also carries the year of
manufacture) and coloured centre line for easy alignment. It is available in diamond or hexagonal
configurations packaged in rolls and diamond is now available in bales too. Both types of Bird Control
Net come in 6 widths ranging from 6.5 m to 17 m.

Other than the pile fabrics of heading 60.01, this heading covers warp knits of a width exceeding 30 cm,
containing no elastomeric yarn or rubber thread or containing less than 5% of such yarn or thread. Details
concerning the manufacture of warp knits (including those made on galloon knitting machines) are to be
found in the General Explanatory Note to Chapter 60, Part (A) (II).
Warp knit fabrics can take various forms. Apart from the traditional fabrics without openings, such as those
used for making garments, they include open-work fabrics. These fabrics, made on warp knitting machines
(especially Raschel machines), are often similar to net fabrics or lace (but should not be mistaken for the
latter : see the Explanatory Note to heading 58.04) and are often used for making curtains. Like machinemade lace, such knitted or crocheted imitations of lace are often produced in fairly wide pieces which are cut
into strips during the finishing process. Such strips, of indeterminate length, fall in this heading provided that
their edges are straight and parallel and that their width exceeds 30 cm.
This heading also excludes:
(a) Bandages, medicated or put up for retail sale (heading 30.05).
(b)Labels, badges and similar articles, knitted or crocheted, of heading 58.07.

APPLICATION FOR A TARIFF CONCESSION ORDER (TCO)
The form should be read carefully before being completed
(a) Before lodging an application for a TCO, the applicant should determine whether a suitable TCO already exists. Information
on existing TCOs is contained in the schedule of Concessional Instruments (SCI), a copy of which is available at each
Regional Office of Customs. A TCO can be used by any importer.
(b) An application will be date stamped on the day it is first received in Canberra by an officer of Customs. Receipt of an
application will be acknowledged. Any resultant TCO will operate from the date of receipt. Instructions on how to lodge this
form are provided at the end of this form.
(c) Where an application is accepted as being a valid application, the identity of the applicant and of the importer for whom
the applicant is acting will be published in the Gazette.
(d) Section 269F of the Customs Act 1901 requires that a TCO application to be in writing, be in an "approved form", contain
such information as the form requires, and be signed in the manner indicated in the form. This is the approved form for
the purposes of that section.
(e) Section 269FA of the Customs Act 1901 states It is the responsibility of an applicant for a TCO to establish, to the
satisfaction of the Chief Executive Officer (CEO), that, on the basis of:
(i) all information that the applicant has, or can reasonably be expected to have; and
(ii) all inquiries that the applicant has made, or can reasonably be expected to make;
there are reasonable grounds for asserting that the application meets the core criteria". The application is taken to meet
the core criteria if, on the day of lodgement of the application, no substitutable goods were produced in Australia in the
ordinary course of business.
(f) Every question on the form must be answered. Failure to supply the information required by this form will result in
rejection of the application (and in the loss of operative date).
(g) Where the form provides insufficient space to answer a question, an answer may be provided in an attachment. The
attachment should clearly identify the question to which it relates.
(h) All information about inquiries into the production of substitutable goods must relate to the date the application is lodged
with Customs.
(i) Customs may require an applicant to substantiate, with documentary evidence, any information provided in the application form.
(j) Further information on the Tariff Concession System is available in Part XVA of the Customs Act 1901, in the foreword
to the Schedule of Concessional Instruments, in the administrative guidelines in Volume 13 of the Australian Customs

A local manufacturer's goods are substitutable when they are put, or are capable of being put, to a use that corresponds with
a use (including a design use) to which the goods the subject of the application can be put (subsection 26913(1) of the Customs
Act 1901). Even if not identical, locally made goods may be substitutable.
In determining whether the uses of Australian produced goods correspond with the uses of the goods the subject of the
application, the ability of the goods to compete with each other in any market is not relevant.
The applicant must provide written information as to the inquiries made to establish that there are reasonable grounds for believing
that there are no producers of substitutable goods in Australia. The application must include a copy ofthe research material sourced
and a copy of correspondence to, and replies from, potential local manufacturers or relevant industry associations. The applieation
will be rejected if it fails to provide all written information as to the inquiries made.

FencestopTM is a temporary knitted visual barrier fence that offers an economical alternative for safety
fencing on building sites and effective pedestrian control around roadwork and construction sites. It's
lightweight, easy to install, reusable and features a strong nylon cord at the top of the fabric which
enables easy tension adjustment and attachment to fence posts.

Gale Pacific Positions Itself for Continuing Northern Hemisphere Growth
A rapid increase in demand from customers in the northern hemisphere has resulted in
Gale Pacific Limited deciding to restructure part of its Braeside manufacturing operation.
Gale Pacific is the leading producer of advanced polymer fabrics and related valueadded products, with approximately 1500 employees worldwide.
The Board of Gale Pacific Ltd has approved a proposal to restructure the Company's
global operations so it can continue to grow and meet increasingly demanding lead
times from its rapidly growing northern hemisphere customer base.
The restructure will involve the redundancy of approximately 100 Braeside
manufacturing positions, with a significant portion of production being transferred to Gale
Pacific's wholly owned China facility. Following the restructure, the Company will retain
and grow the significant production capability of Gale Pacific's remaining industrial
fabrics plants in Braeside and New Zealand.
Gale Pacific will honour all staff entitlements and provide significant outplacement and
counselling services to help staff find new employment.
This restructure is no way a product of Australian economic, industrial or political factors
— Gale Pacific values the strong support it has received from its staff, governments and
the local community.
It is a result of rapid sales growth from customers in the northern hemisphere (expected
to account for 70% of sales of value added consumer products within three years), and
the realisation that we must improve our lead times to outperform our competitors.
This year the Company could not fully take advantage of significant sales opportunities
due to its long lead times in both the European and US markets. With this restructure we
can expect improved earnings from increased revenue, and a dramatically improved
supply chain operation for our northern hemisphere markets.
Gale Pacific is confident the restructure will ensure the Company can continue to grow
and strengthen its position as the world's leading manufacturer and exporter of
advanced polymer fabrics and related value-added products.
The financial effect of the restructure will be both earnings and cash flow positive in the
2005-2006 transition year after expensing approximately $2.3M (before tax) of
redundancy and relocation costs, with the full benefits of the restructure to be realised in
2006/200T

Quilting
A fabric construction in which a layer of down or fiberfill is placed between
two layers of fabric, and then held in place by stitching or sealing in a
regular, consistent, all-over pattern on the goods.

Ramie
A bast fiber, similar to flax, taken from the stalk of a plant grown in China.
Raschel Knit
A warp knitted fabric in which the resulting knit fabric resembles hand
crocheted fabrics, lace fabrics, and nettings. Raschel warp knits contain
inlaid connecting yarns in addition to columns of knit stitches.
Rib Knit
A basic stitch used in weft knitting in which the knitting machines require
two sets of needles operating at right angles to each other. Rib knits have a
very high degree of elasticity in the crosswise direction. This knitted fabric is
used for complete garments and for such specialized uses as sleeve bands,
neck bands, sweater waistbands, and special types of trims for use with other
knit or woven fabrics. Lightweight sweaters in rib knits provide a close,
body-hugging fit.
Rib Weave
One of the plain weave variations, which is formed by using: 1) heavy yarns
in the warp or filling direction, or 2) a substantially higher number of yarns
per inch in one direction than in the other, or 3) several yarns grouped
together as one. Rib fabrics are all characterized by having a slight ridge
effect in one direction, usually the filling. Such fabrics may have problems
with yarn slippage, abrasion resistance, and tear strength. Examples of this
construction include broadcloth, poplin, taffeta, faille, shantung, and cord
fabric.
Rayon
A manufactured fiber composed of regenerated cellulose, derived from wood
pulp, cotton linters, or other vegetable matter. Today, various names for
rayon fibers are taken from different manufacturing processes. The two most
commonly used production methods for rayon are the cuprammonium
process and the viscose process.

• Other fabrics will loosen and sag overtime, our
:'Cooltone" fabric, a knitted high density
polyethylene imported from South Africa,
literally can not and will not sag. It will not
stretch beyond it's intended size! In a process
called "Stentering", the polyethylene has been
vaporized to eliminate the "droop" factor.

• A method of knitting called "Raschell" knitting is
used in our fabric. Round threads are knitted
together, looped and locked in a twill-like
pattern that offers incredible strength. Broad
flat polyethylene strips are woven through the
knit to form the actual shade cover, while
leaving enough space for warm air to rise
straight through the fabric and away from the
structure. Acrylics, canvas and other types of
solid shade coverings actually add to the heat
by trapping hot air below the structure.

• The fabric has a bursting strength is 350Ib/sq.
inch. It is primarily for Sun/Uv protection as
well as being hail proof and mold proof. The
fabric is highly chemically resistant and will not
be effected permanently by foreign substances
(i.e bird deliveries, paint, tree sap, etc.). It
cleans with a quick spray from a garden hose.

temperatures dramatically and providing up to
88% shade. The amount of protection depends
upon which color is utilized, the darker the
color, the greater the blockage.
• Almost all companies that supply shadecloth
cable tension structures utilize netting that is
manufactured in South Africa by one of two
companies, either Knittex or Alnet. We import
our shadecloth directly from Alnet, which is
located in Capetown, South Africa. Shade 'N Net
is also a distributor for Alnet, selling to awning
companies in other states. Every company will
tell you why the shadecloth they use is
superior. We only suggest that our clients get a
sample of both and judge for themselves. The
difference was obvious to us, that's why we
chose Alnet. Ainet's shadecloth is the only
netting endorsed by the South African Cancer
Society!

TARIFF CONCESSION SYSTEM
NOTIFICATION OF APPLICATION
An application has been made for a Tariff Concession Order (TCO) as described in the
attachment.
The Tariff Concession System allows for a concessional rate of Customs duty where it can be
established that on the day on which the application was lodged, no substitutable goods were
produced in Australia in the ordinary course of business.
To allow for comments by local manufacturers, all applications for Tariff Concession Orders are
published in the Commonwealth Gazette. In this instance, Customs is bringing to your attention
Gazette Number TC06/23 of 14 June 2006 in which a description of the goods in the attachment
has been published.
In accordance with section 269M of the Customs Act 1901, you are invited to lodge a
submission objecting to the making of this TCO if you consider that you have any reasons to
oppose the making of the TCO.
Objections to Tariff Concession Orders by local manufacturers must be submitted on an
approved form. As required by legislation, your submission must be lodged with Customs in
accordance with the methods of lodgement specified on the approved form no later than 3
August 2006.
