By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, you are not permitted to install or use the Software. END-USER LICENSE If you have purchased a single license, you have the right to install and use one copy of the Software on a single handheld computer. If you have purchased a multiple user license, you may install and use the Software ONLY for the maximum number of users permitted by your license. You may permanently transfer all of your rights under this EULA, provided the recipient agrees to the terms of this EULA. Without prejudice to any other rights, Cerience may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Software. COPYRIGHT AND RESTRICTIONS All title and copyrights in and to the Software are owned by Cerience or its suppliers. The Software is protected by copyright laws and international treaty provisions. You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. If this Software is part of a "beta" or "pre-release" program offered by Cerience, you must treat it as confidential and may not disclose any information regarding the Software to any third party without prior approval from Cerience. SUPPORT SERVICES Cerience may provide you with support services related to the Software ("Support Services"). Use of Support Services is governed by the Cerience policies and programs described in the user manual, in "online" documentation, and/or in other Cerience-provided materials. Any supplemental software code provided to you as part of the Support Services shall be considered part of the Software and subject to the terms and conditions of this EULA. U.S. GOVERNMENT RESTRICTED RIGHTS The Software and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. Ownership: If you provide feedback or suggestions about Google’s services, then Google may use such information without obligation to you. By using the Google services you do not acquire ownership of any rights to such services or the content that is accessed through the APIs for such services. You will not make any statement regarding your use of a Google service which suggests partnership with, sponsorship by or endorsement by Google without Google’s prior written approval. Termination: Google reserves the right to terminate these terms or discontinue the services or any portion or feature for any reason and at any time without liability or other obligation to you. Upon termination of these terms or discontinuation of your access to the services, you will immediately stop using the Google services. When these terms come to an end, those terms that by their nature are intended to continue indefinitely will continue to apply, including but not limited to the warranties, limitation of liability, indemnity and modifications sections below. The APIs and content accessed through the APIs are provided "as is". To the extent permitted by law, we exclude all implied warranties. Limitation of Liability: When permitted by law, Google, and Google's suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages. To the extent permitted by law, the total liability of Google, and its suppliers and distributors, for any claim under these terms, including for any warranties that may not legally be excluded, is limited to the amount you paid us to use the APIs (or, if we choose, to supplying you the APIs again) during the six months prior to the event giving rise to the liability. In such a case, Google will provide you with written notice of such claim, suit or action. General Legal Terms: These terms control the relationship between Google and you. If it turns out that a particular term is not enforceable, this will not affect any other terms.
