2010-06-23 Canada Gazette Part II, Vol. 144, No. 13 Gazette du Canada Partie II, Vol. 144, no 13 SOR/DORS/2010-120 toxic or oxygen-deficient atmosphere, the employer must prepare a report in writing including the following information: (a) the type of result of the hazardous occurrence; (b) the employer’s name, mailing address and telephone number; (c) the location, date and time of the hazardous occurrence; (d) the weather conditions at the time of the hazardous occurrence; (e) the names of any witnesses to the hazardous occurrence; (f) the supervisor’s name; (g) the name of the vessel and its official number or ID Number; (h) a description of what happened; (i) a description and estimated cost of property damage, if any; (j) for each injured employee, the employee’s name, date of birth, sex, years of experience in the occupation, a description of the injury, whether the employee was evacuated and the direct cause of the injury; (k) the training in accident prevention given to each injured employee in relation to the duties the employee performed at the time of the hazardous occurrence; (l) the direct causes of the hazardous occurrence; (m) any corrective action taken or to be taken and the date of its implementation; (n) measures taken or to be taken for the purpose of complying with the Act, in addition to those required by the regulations; (o) the name of the person investigating the hazardous occurrence, their title, telephone number, signature and the date of their signature; and (p) the name of the work place committee member or health and safety representative who participated in the investigation of the hazardous occurrence, their title, telephone number, signature and the date of their signature. (2) The employer must submit a copy of the report (a) within 30 days after the date of the hazardous occurrence, to a health and safety officer employed with the Transport Canada Marine Safety Office and to the Canadian Transportation Accident Investigation and Safety Board; and (b) without delay, to the work place committee or health and safety representative, as the case may be. ou d’une exposition à des gaz toxiques ou à de l’air à faible teneur en oxygène, l’employeur établit un rapport écrit qui contient les renseignements suivants : a) la conséquence entraînée par la situation; b) le nom de l’employeur, son adresse postale et son numéro de téléphone; c) les date, heure et lieu où s’est produite la situation; d) les conditions météorologiques au moment où s’est produite la situation; e) les noms des témoins de la situation; f) le nom du surveillant; g) le nom du bâtiment et son numéro officiel ou numéro d’identification; h) la description de la situation; i) la description des dommages aux biens et leur coût estimatif, s’il y a lieu; j) pour chaque employé blessé, son nom, sa date de naissance, son sexe, le nombre d’années d’expérience au poste, une mention indiquant s’il a été évacué, ainsi que la description et la cause directe de sa blessure; k) une mention de l’entraînement en prévention des accidents offert à chaque employé blessé relativement aux fonctions qu’il exerçait au moment où la situation s’est produite; l) les causes directes de la survenance de la situation; m) les mesures correctives qui ont été prises ou qui doivent être prises et la date de leur mise en œuvre; n) les mesures qui ont été prises ou qui seront prises pour satisfaire aux exigences de la Loi, en plus des mesures prévues par le présent règlement; o) le nom de la personne responsable de l’enquête sur la situation, son titre, son numéro de téléphone ainsi que sa signature et la date à laquelle celle-ci a été apposée; p) le nom du membre du comité local ou du représentant qui a participé à l’enquête, son titre, son numéro de téléphone ainsi que sa signature et la date à laquelle celle-ci a été apposée. (2) L’employeur présente le rapport : a) dans les trente jours suivant la survenance de la situation, à un agent de santé et de sécurité du bureau de la sécurité maritime, ministère des Transports et au Bureau canadien d’enquête sur les accidents de transport et de la sécurité des transports; b) sans délai, au comité local ou au représentant, selon le cas. ANNUAL REPORT RAPPORT ANNUEL 280. (1) Every employer must, not later than March 1 in each year, submit to the Minister a written report that sets out the number of accidents, instances of occupational disease and other hazardous occurrences of which the employer is aware that have affected any employee in the course of employment during the 12-month period ending on December 31 of the preceding year. (2) The report must contain the following information: (a) the year for which the report is submitted; (b) the employer identification number; (c) the work place address; (d) the number of disabling injuries; (e) the number of deaths; (f) the number of minor injuries; 280. (1) L’employeur, au plus tard le 1er mars de chaque année, présente au ministre un rapport écrit indiquant le nombre de situations comportant des risques, notamment les accidents ou les maladies professionnelles, dont il a connaissance et qui ont touché certains de ses employés au travail au cours de la période de douze mois se terminant le 31 décembre de l’année précédente. (2) Le rapport contient les renseignements suivants : a) l’année pour laquelle le rapport est présenté; b) le numéro d’identification de l’employeur; c) l’adresse du lieu de travail; d) le nombre de blessures invalidantes; e) le nombre de décès; f) le nombre de blessures légères; 1130
