BellSouth Telecommunications, Inc. (iiBellSouth”), pursuant to Section
120.542, Florida Statutes, and Rule 28-1 04.002, Florida Administrative Code,
hereby petitions the Florida Public Service Commission (“Commission”) to waive
the requirements of Rule 25-4.079(5), Florida Administrative Code, regarding
BellSouth’s provision of specialized Customers Premises Equipment (“CPE”) for
lease or sale to hearinglspeech impaired persons for the reasons set forth below.
Specifically, BellSouth seeks the following:
1.
BellSouth is a local exchange company lawfully doing business in
the State of Florida whose regulated operations are subject to the jurisdiction of
the Commission pursuant to Chapter 364, Florida Statutes.

BellSouth’s principal place of business is 675 West Peachtree St.,
NE, Suite 4500, Atlanta, Georgia 30375. Pleadings and process may be served

Subsection (5) of Rule 25-4.079 requires LECs, pursuant to tariff, to
provide specialized CPE, for lease or sale, at cost, to hearingkpeech impaired
persons.

Specifically, Rule 25-4.079(5) provides as follows:
(5) Each LEC shall, pursuant to tariff, provide specialized customer
premises equipment (CPE), for lease or sale, to hearingkpeech
impaired persons. This specialized CPE shall be priced to cover
fully allocated costs without inclusion of a rate of return on
investment component. Each LEC shall provide at least one type
of each of the following categories of specialized CPE:

volume control handsets.
Rule 25-4.079 cites to Florida Statutes 5 350.127(2) as the “specific
authority” for the Rule. Florida Statutes §§ 364.01(4), 364.02, 364.025, 364.03
364.04 are cited to as the “Law Implemented.”

The Rule’s purpose is to provide to hearingkpeech impaired
persons the same telecommunications opportunities that are available to other
subscribers at reasonable costs. See In re: Adoption
of Rule 25-4.079 -
HearingBpeech Impaired Persons, Docket No. 870744-TP, Order No. 18789
(February 3, 1998).

Subsequent to the Rule’s enactment, in 1991, the Florida
Legislature passed the Telecommunications Access System Act (“TASA”) (§§
427.701-427.708). The intent of TASA is to provide access terminals required for
basic telecommunications services for Deaf, Hard of Hearing, Speech Impaired

and Dual Sensory Impaired persons, in the most cost effective way. See F.S. §
427.702.

TASA
required the
Commission to designate
a
non-profit
corporation to administer the telecommunications relay service system and
distribute specialized telecommunications devices, such as TDDs, volume control
handsets, and ring signaling devices. See F.S. § 427.704(1). In response to this
mandate, the Commission directed LECs to form a non-profit corporation to fulfill
the TASA requirements.

The non-profit corporation formed by the LECs is known as Florida
Telecommunications Relay, Inc. (“FTRI”).

The costs incurred by FTRl of providing telecommunications relay
services and distributing specialized telecommunications devices is spread
equitably among and collected from customers of all local exchange
telecommunications companies in the State of Florida. See F.S. § 427.702(3)(i).

FTRl’s equipment distribution program and the Florida Relay are
funded by a monthly surcharge billed to all telephone customers in Florida. See
F.S. 5 427.704(4)(a)(I). Through this program, FTRl loans specialized telephone
equipment and ring signaling devices to all qualified permanent residents of
Florida for as long as they need it, at no charge. See documents obtained from
FTRl’s website at www.flri.orq attached hereto as Exhibit “A.”

FTRl provides, inferalia, at no charge, a Volume Control Phone for
the Hearing Impaired; a Volume Control Phone for the Speech Impaired; a Text
Telephone, also known as a Telecommunications Device for the Deaf; an

Audible Ring Signaler; and a Visual Ring Signaler. See list of FTRl products
attached hereto as Exhibit “B.”

FTRl has contracted with non-profit organizations throughout the
state to be Regional Distribution Centers to meet the needs of hearing and
speech impaired residents. At these centers, a hearingkpeech impaired person
may have an equipment application processed, see a demonstration of the
equipment, receive equipment training, receive ongoing equipment maintenance
service and obtain local support services. See list of the FTRl’s Regional
Distribution Centers attached hereto as Exhibit “C.”

FTRl’s application process is a simple process. See FTRl
application forms attached hereto as Exhibit “D.”

Since the enactment of the Rule, BellSouth has been providing
specialized CPE to its hearingkpeech impaired customers in Florida.
16.
Currently, very few hearingkpeech impaired customers purchase
or lease specialized CPE from BellSouth. Specifically, for the last three year
period from January 1, 2003 to December 31, 2005 only a total of 608 pieces of
equipment were sold or leased in Florida.

The Commission’s requirement that BellSouth provide specialized
CPE to customers imposes a financial burden on BellSouth because it forces
BellSouth to incur administrative costs in complying with the Rule. In addition, the
Rule requires BellSouth to only charge its costs for the equipment. Such a
requirement is no longer necessary given the FTRl’s provision of this same
equipment for free. Further, to the extent a hearingkpeech impaired customer

desires to purchase/lease the equipment from BellSouth instead of receiving it
from FTRI, BellSouth should be allowed to charge competitive prices consistent
with other providers of the same equipment. Indeed, there are numerous
competitive providers who are providing the same or substantially similar
equipment at prices that are below, the same or higher than the prices that
BellSouth is currently charging for the specialized CPE for those individuals who
decide not to obtain the specialized CPE from FTRI. See documents obtained
from the websites of competitive providers attached hereto as Exhibit “E.”
18.
Based upon the Commission’s direction to the LECs to create
FTRI, it is quite evident that a Commission rule requiring a LEC to provision,
pursuant to tariff, specialized CPE, for lease or sale, to hearingkpeech impaired
persons, is no longer needed to protect Florida consumers and is an
unnecessary regulatory and financial burden on LECs. No hearing/speech
impaired persons would be prejudiced by such a finding because they can obtain
substantially similar equipment from FTRI for free.
19.
The specific facts provided above clearly demonstrate that
BellSouth suffers a substantial hardship that would justify a waiver for BellSouth.
20.
Accordingly, based upon the foregoing, BellSouth requests that the
Commission permanently waive the provisions of FPSC Rule 25-4.079(5)
requiring BellSouth to provide, pursuant to tariff, specialized CPE, for lease or
sale, at cost, to hearinglspeech impaired persons.
WHEREFORE’ BellSouth requests that, having demonstrated good
cause, the Commission waive the provisions of Rule 25-4.079(5) that require

Florida Telecommunications Relay, Inc. (FTRI) is
a statewide not-for-profit organization that
administers the Specialized Telecommunications
Equipment Distribution Program for citizens of
Florida who are Deaf, Hard of Hearing,
Deaf/Blind and Speech Impaired.
The Florida Legislature passed the
Telecommunications Access System Act (TASA)
in 1991. The intent of TASA (F.S. 427) is to
provide access terminals required for basic
telecommunications services for Deaf, Hard of
Hearing, Speech Impaired and Dual Sensory
Impaired persons, in the most cost effective
way.
I n response t o TASA, the Florida Public Service
Commission (FPSC) directed local exchange
telephone companies to form a not-for-profit
Corporation to fulfill the TASA requirements. FTRI
registered with the Florida Department of State
as a not-for-profit corporation, effective June 13,
1991, and is a 501(c) (3) corporation.
TASA mandates that the FTRI equipment
distribution program and the Florida Relay be

Qualifying is a simple process.
Just meet these eligibility requirements:
Re a Florida resident.
Be three years of age or older to receive the Volume Control
Phone for the Hearing Impaired (VCPH), In-Line Amplifier
(ILA), Audible Ring Signaler (ARS), or Visual Ring
Signaler (VRS).
Be five years of age or older to receive a Text Telephone
(TTY).
Bc ccrtified a s having one of the following impaimients:
+ Deaf: You must have permanent hearing loss and be
unable to recognize speech sounds during telephone
convcrsations with or without an amplification device.
Hard of Hearing: You must have a permanent hearing
loss severe enough that you need to use ampliiication
devices to recognize speech sounds during telephone
conversations.
+ Deaf/Blind: You must be deaf and blind or have both a
permanent hearing and visual impaimlent.
Speech Impaired: You must have a permanem: speech
impairment so that you cannot use a standard telephone.
Receiving the specialized
equipment is easy.
Just follow these three steps:
1. Meet the eligibility requirements listed above.
2. Fill out the attached FTRl equipment application. (See the
instructions that follow.)

equipment. They may visit one of FTRl’s Regional Distribution
Centers (RDCs), or they can have their equipment application
processed through FTRI by mail. They also can request to have
their equipment shipped to their certifier, if appropriate.

Allow 4-6 weeks for processing and shipping after FTRl

What is a Public Phone TDD?
The Public Phone TDD is a TDD (or -Tp/)
which has been designed to work with any
public telephone. T p / s are devices that
people who are deaf, hard-of-hearing, o r
speech impaired use to make telephone calls.
This low profile Tp/ may be mounted on an
existing pay phone shelf with any available
flat surface measuring 9.5” W X 8.5“ L X
1.25” H. The high-tech, stainless steel unit consists o f a vandal-proof, sealed
keyboard (to resist spilled liquids); bright, 16-character display screen; call
progress indicator. This is a direct-connect TTY that is hard-wired through the tip
and ring terminals of the public telephone. Simply turn the power on press any key
to turn power on and proceed with the T7y call as usual. We can supply the cabinet
enclosure at an additional charge.
