3.3Non-Refundable.Pre-paidfeesarenon-refundable.
3.4Cancellation.TocancelyourSubscriptionPlan,youmustnotifyINREACHinwritingwithin
thirty (30) days of the end of your Subscription Plan's Term.You must email your notice of
cancellation to [email protected] and provide your name, your address and the IMEI from
the INREACH Product for which you want to cancel service (located in the battery
compartment, under the battery of your INREACH Product). You may contact INREACH
customer service at [email protected] cancel or if you have questions. You still must
[email protected].
3.5ChangestoServices.YouagreethatINREACHoritsserviceproviders(includingDeLorme,
Iridium,andGEOS)maymakechangestotheServicesinordertocomplywithapplicablelaws,
to maintain or improve the Services or for other business reasons without notice to you and
without liability for any changes in your ability to use the Services or the INREACH Products,
includingcompatibilityissueswiththeINREACHProducts,asaresultofsuchchanges.
3.6 Termination by INREACH. You agree that INREACH may terminate this Agreement and
theprovisionofServicestoyouatanytimewithoutnoticeorliabilitytoyouifyouareinbreach
ofthisAgreement.
3.7AdditionalCharges.Yourcellphoneserviceproviderand/orinternetprovidermaycharge
you or your recipients additional fees in relation to any SMS / MMS messages, social
connectivitymessagesand/orotheremailsand/ordata(collectively"DataPlanFees")sentby
you. Please familiarize yourself with any such applicable plans, Services and associated fees
beforeusingyourINREACHProduct.Youareresponsibleforanysuchapplicablechargesand
fees.
4.PAYMENT.
4.1 Timely Payments. You agree to pay, on time, any applicable activation, for your
Subscription Plan, usage, cancellation, and disconnection fees, plus any applicable taxes, as
providedinyourSubscriptionPlan.SinceyourSubscriptionPlanwillrenewautomaticallyatthe
end of each term, your fees for the renewal term shall be due and payable in the currency
specifiedinyourSubscriptionPlanuponrenewal.
4.2LatePayments.Youagreetopayalatechargeofthelesserof(i)1.5%permonthor(ii)
themaximumlegalrateifyourbillisnotpaidwithinten(10)daysaftertheduedate.Thislate
chargeisapplicabletotheunpaidbalanceasoftheduedateandwillbebilledonsubsequent
invoicesandstatements.YouagreetopayINREACHallofINREACH'scollectioncosts,including
without limitation the standard fees of any collection agency, reasonable attorney and legal
fees, and any other costs incurred by INREACH in exercising any of its rights under this
Agreement. INREACH may suspend the Services in the event of late payment. If it does so,
INREACHmaychargeareactivationfee(currently$50.00US)foreachsuspendedSubscription
Plan.
